Is my existing will still valid?
Most wills become outdated over time due to life changes.
In Malaysia, marriage automatically revokes a prior will under the Wills Act 1959 unless written in contemplation of that marriage. Other common triggers include buying new assets, stocks, having children, restructuring a business, or an executor/beneficiary passing away or moving away. Additionally, EPF nominations cannot be overridden by a will.

Does a Will help if I am incapacitated?
A will does nothing while you are alive. That gap is wider in Malaysia than most people assume, because we have no lasting power of attorney.
An ordinary power of attorney under the Powers of Attorney Act 1949 is revoked when the donor becomes mentally disordered. The moment your family most needs it is the moment it stops working. From there the only route is a court application under the Mental Health Act 2001 to have you declared mentally disordered and a committee appointed over your estate — months, legal costs, and a public court process, while your family is still absorbing the diagnosis.
A Mental Capacity Act has been proposed for years. It is still not law.
The instrument that works today is a trust set up while you still have capacity. Whether it holds, and whether the trustee can actually act, comes down to how the deed is drafted. That is a legal question, and it is the clearest reason to sit with a legal advisor rather than an agent.

Extremely affordable given a face to face consultation and drafting by a legal advisor. Packages start from RM450 for a simple will and go to RM1,950 for a will containing a testamentary trust, with lifetime custody available at RM998.
